Le nouveau Code de procédure civile au prisme des technologies de l’information

With the adoption of the new Code of Civil Procedure, the legislator intends to bring the civil justice system into the 21st Century, making it faster, cheaper, more accessible and less cumbersome – especially through the use of information technologies. Thus, unlike the last Code of Civil Procedure, several provisions refer specifically to information technologies. The present paper aims to better understand the technological aspects of this new legislation. On one hand, the favoring of technological means (rule of application; section 26) and the procedural proportionality (guiding principle; section 18) will be put into perspective. On the other hand, the examination of witnesses through technological means and the electronic notification will be subsequently analyzed.
