Du droit cosmopolitique au droit global : pour une rupture épistémologique dans l’approche juridique

The following article aims to raise awareness among jurists through an epistemological reflection on the concepts of Cosmopolitan law and Global law. Both appear to us somehow neglected today. In a perspective of rehabilitation, we voluntarily leave aside the classic legal approach to instead choose a scientific approach in three steps. First, we will radically break with the legal illusion that is essentially based on methodological nationalism and legal positivism. Second, we shall present the theoretical construction of Cosmopolitan law through its genesis and updating. Thirdly, we will figure, in an empirical way, that the emerging notion of “Global administrative law” is dramatically linked to Cosmopolitan right.
